On the question of whether the appointment of Stipendiary Magistrates should rest with The Governor or with the Chief Justice, I have to observe, adverting to the peculiar relations which subsist between a Judge and his staff, that the nomination should belong to the Chief Justice, but in conveying to him this conclusion I have further to direct you to acquaint the Chief Justice that I must request each such nomination to be immediately reported through the Governor for the purpose of receiving that approval by the Secretary of State which is required for all appointments in the Colonies.
